1. Acceptance of Terms

By downloading, installing, or using NebulaSend ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License Agreement

NebulaSend is commercial software. Upon payment, you receive a non-exclusive, non-transferable license to use the Software on a single computer. The license is hardware-locked to the computer on which it is first activated.

3. Prohibited Uses

You agree NOT to:

• Use the Software to send spam, unsolicited bulk emails, or harassing messages
• Violate any applicable laws or regulations (CAN-SPAM Act, GDPR, etc.)
• Share, resell, or distribute your license key to third parties
• Attempt to reverse engineer, decompile, or bypass the license system
• Use the Software for illegal activities or to harm others

4. SMTP Pool Usage

The Software connects to NebulaSend's SMTP pool. You agree to use the allocated SMTP servers responsibly and within your plan's daily limits. Abuse of the SMTP pool (excessive sending, spam complaints) may result in immediate termination of your license without refund.

5. Payment and Refunds

All payments are processed via cryptocurrency (USDT/BTC). Due to the nature of digital goods and instant license activation, refunds are generally not provided. Exceptions may be made at our sole discretion for technical issues preventing Software usage.

6. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not guarantee that emails will always land in inboxes, as deliverability depends on recipient servers and content quality.

7. Limitation of Liability

In no event shall NebulaSend be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Software.

8. Termination

We reserve the right to terminate or suspend your license immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our SMTP infrastructure.

9. Changes to Terms

We may modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the new Terms.
